THIS PRIVACY POLICY (this “Privacy Policy”) explains how Malaspina Media, LLC (“Malaspina Media” or “we”) collects, uses, and discloses your information. The PetMatchBook website and mobile applications are operated by Malaspina Media. By accessing or otherwise using the PetMatchBook application or website, or any part thereof (collectively, the “App”), you agree to this Privacy Policy, and consent to the processing of your information according to this Privacy Policy. This Privacy Policy is also incorporated into the PetMatchBook Terms and Conditions, which also apply when you use the App. If you do not agree to this Privacy Policy, please do not provide us with any personal information or interact with the App.

1. COLLECTION OF INFORMATION. We may collect certain information from you or about you, including:

a. Information You Provide to Us. In general, we collect personal information that you submit to us through the App, including any personal information that you submit in the process of creating or editing your Account on the App. For example, the Account registration process requires you to provide your first and last name, email address, password, and access to your Facebook account. Full use of the App may require you to enter a valid address, zip code, location information (including GPS positioning), year of birth, gender, and other demographic information, or to upload photographs of you or your pet. If you sign up to receive information about Malaspina Media products or services, or “refer a friend” through the App, we may collect your email address as well as any other email addresses you provide.

b. Information Collected Through Technology. Similar to most other websites, Malaspina Media gathers certain non-personal information automatically and stores it in log files. This information may include IP addresses, browser type, Internet service provider, referring/exit pages, operating system, date/time stamp, and clickstream data. Additionally, Malaspina Media may collect information stemming from your use of a mobile device if you downloaded the mobile application, including the mobile device model software version and device carrier. We also gather certain information from “cookies,” which are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website. We may use both session Cookies, which expire once you close your web browser, and persistent Cookies, which stay on your computer until you delete them. You are able to reject the use of Cookies, but doing so may impair your ability to fully utilize our services. In addition to the use of Cookies, we may use “Pixel Tags” or web beacons in order to track the online movements of web users. We use third-party advertising companies to serve advertisements on our behalf or to provide advertising-related services. These companies may use a cookie or an action tag, to tailor the advertisements you see on this Website and other sites, to track your response to their advertisement, to determine whether advertising has been served, and to measure the effectiveness of their advertising or to award incentives or points to their members who respond to their advertisements. The cookies, action tags, or similar files do not contain any personal information.

c. Information Gathered Through Third Parties. We may receive personal information about you from other sources with which you have registered or interacted, companies with who we have partnered, or other third parties. Some of the information collected may include how often a user visits the App, what features they use on the App, and what other sites or Apps they used prior to coming to our App. This information is generally non-personally identifiable information. The App may allow you to log in through social networking sites, such as Facebook and Google Plus (each an “SNS”). By logging in to the Services through an SNS, you consent to our collection of information from the SNS. Any information that we collect from an SNS may depend on your then-current SNS privacy settings, so please consult the SNS’ privacy and data practices and edit privacy settings in the SNS if you choose.

2. USE OF INFORMATION.

a. General Use. In general, Malaspina Media uses your personal information and any other information you submit or share with us for the following purposes:
· To facilitate the creation of and to secure your Account;
· To identify you as a user in our system;
· To provide, maintain, protect, develop and improve Malaspina Media and our Services;
· To provide the Services you request;
· To improve the quality of experience when you interact with the App;
· To send you administrative email notifications, such as security, confirmation or support advisories;
· To respond to any inquiries you may have regarding Malaspina Media, the Services and the App;
· To customize the content and advertisements you receive from us and our trusted partners;
· To send newsletters, surveys, offers, and other promotional materials related to our Services and for other marketing purposes of Malaspina Media;
· To contact you for feedback about our Services; and
· To notify you of technical updates of changes in our policies.

b. Creation of Anonymous Data. We may create anonymous data records from personal information by excluding information (such as your name) that makes the data personally identifiable to you. We use this anonymous data to analyze requests and usage patterns so that we may enhance the content of our Services and improve the App. We reserve the right to use anonymous data for any purpose and disclose anonymous data to third parties at our sole discretion.

c. Disclosure of Personal Information. Malaspina Media may provide your personal information to third-party service providers, affiliates, or partners who work on behalf of or with us to provide some of the services and features of the App and to help us communicate with you. Examples of this may include sending emails, processing payments, and providing customer service. We limit the information provided to the aforementioned affiliates and partners to the extent necessary for them to provide the services and require such service providers to promise not to use such information except as necessary to provide the services to us. In the event, we go through a business transition such as a merger, acquisition by another company, sale of all or a portion of our assets, consolidation, restructuring, financing, or other corporate change, including during the course of any due diligence process or if Malaspina Media should ever file for bankruptcy or related proceeding, your personal information may be among the assets transferred. You acknowledge that such transfers may occur and are permitted by this Privacy Policy and that any acquirer of ours or that acquirer’s assets may continue to process your personal information as set forth in this Privacy Policy. Lastly, we may disclose your personal information if we believe in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas or warrants served on us; (b) protect and defend our rights or property, you, or third parties; or (c) investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms and Conditions. You hereby consent to us sharing your personal information under the circumstances described herein.

3. YOUR CHOICES REGARDING YOUR INFORMATION. We offer you several choices regarding the collection, use, and sharing of your personal information.

a. Promotional and Marketing Materials. You have a right at any time to stop us from contacting you for marketing purposes. When you receive promotional communications from us. You may indicate a preference to stop receiving further promotional communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions. Please note, however, that despite your indicated email marketing preferences, we may send you administrative emails regarding Malaspina Media, including transactional confirmations and notices of updates to this Privacy Policy.

b. Changing or Deleting Personal Information. You may change any of your personal information in your Account by editing your settings within your Account. You may request the deletion of your personal information by us, and we will use commercially reasonable efforts to honor your request, but please note that we may be required to keep such information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives or backups. We may also retain your information for fraud prevention or similar purposes.

c. Browser Options. You may manage how your browser handles Cookies by adjusting its privacy and security settings. Browsers are different, so refer to instructions related to your browser to learn about cookie-related and other privacy and security settings that may be available. You have choices about third-party advertising: both the Network Advertising Initiative and the Digital Advertising Alliance allow you to opt-out of the above cookies, beacons, or other online behavioral advertising by their participating companies. Some web browsers also may transmit “do not track” signals to the websites and other online services with which your web browser communicates. We currently do not take action in response to these signals.

4. MISCELLANEOUS.

a. Security. We are committed to protecting the security of your Personal Information. We use a variety of industry-standard security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. Even though we have taken significant steps to protect your personal information, no company, including us, can fully eliminate security risks associated with personal information.

b. Children’s Personal Information. We require registered users of the site to be at least eighteen years old. Protecting the privacy of children is very important. If we obtain actual knowledge that a registered user is under eighteen, we will promptly delete information associated with such an account. By using Malaspina Media, you are representing that you are at least eighteen years old.

c. Information Given Over Messenger. The App may feature a messaging service (“Messenger”) that allows users to communicate with one another. We use a number of industry-standard security technologies and procedures to help protect the personal information you may send another user using Messenger. However, we are not responsible for the security of any information or images that you choose to send to other users via Messenger, and advise you to be careful when deciding which information you will share. We are also not responsible for the content other users send to you using Messenger, including but not limited to any offensive language or images. We ask you to immediately bring any such inappropriate material to our attention.

d. Use of Location Services. You understand that if, when using the App, you indicate that your pet is currently with you, the App may begin tracking your location and your location will be available to other App users. Malaspina Media (including its officers, directors, employees, agents, representatives, and affiliates) expressly disclaims all responsibility and liability arising from (a) any person identifying your location and (b) any claims that may result directly or indirectly therefrom. Malaspina Media urges you to use caution when approaching or interacting with other users, especially those you do not know. If you do not want to be visible to others, you must use the features available in the App to make your location invisible.

e. Changes to this Privacy Policy. This Privacy Policy is subject to occasional revision at our discretion, and if we make any substantial changes in the way we use your personal information, we will post an alert on this page or may otherwise post an alert on the App or notify you by email correspondence. If you object to any such changes, you must cease using Malaspina Media. Continued use of Malaspina Media following notice of any such changes shall indicate your acknowledgment of such changes and agreement to be bound by the terms and conditions of such changes. The date of the most recent update of this document will always be displayed at the end of this page. We encourage you to periodically review this Privacy Policy to stay informed about how we are protecting the Personally Identifiable Information we collect.

f. California Residents. If you are a California resident, you may request that we provide to you (i) a list of the categories of personal information about you that we have disclosed to third parties for the third parties’ direct marketing purposes during the calendar year preceding your request, (ii) the names and addresses of such third parties, and (iii) if the nature of the third parties’ business cannot reasonably be determined from their names, examples of the products or services marketed if known to Malaspina Media, sufficient to give you a reasonable indication of the nature of the third parties’ business.
